Terms of Service

1. Acceptance of Terms

By accessing our website or engaging Nine Pixels for development services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

These terms apply to website visitors and clients engaging Nine Pixels for game development, app development, QA, hiring, or any other service we provide.

2. Services

Nine Pixels provides game development, app development, QA testing, developer hiring, live ops, and post-launch support services. The specific scope, deliverables, timeline, and pricing for any engagement are defined in a separate Statement of Work (SOW) or service agreement, which forms part of the contract between us.

We reserve the right to refuse service to any party at our discretion.

3. Intellectual Property

Unless otherwise agreed in writing in a specific project agreement:

• All deliverables created by Nine Pixels under a fixed-price or dedicated team engagement transfer to the client upon receipt of full payment
• Work in progress remains the property of Nine Pixels until payment milestones are met
• Nine Pixels retains ownership of pre-existing tools, frameworks, and processes used in the delivery of services
• Client-provided materials (code, assets, brand guidelines) remain the property of the client

4. Confidentiality

Nine Pixels treats all client project information as confidential by default. We will not disclose your project details, business information, or unreleased game content to third parties without your consent, except where required by law.

Formal Non-Disclosure Agreements are available on request before any project discussion begins.

5. Payment Terms

Payment terms for services are defined in individual project agreements. In general:

• Fixed price projects are invoiced in milestones as defined in the SOW
• Dedicated team and staff augmentation engagements are invoiced monthly in advance
• Invoices are payable within 14 days of issue unless otherwise agreed
• Late payments may incur interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts Act 1998

6. Limitation of Liability

To the maximum extent permitted by law, Nine Pixels’ liability for any claim arising from our services is limited to the total fees paid by the client in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental losses including lost revenue, lost data, or business interruption.

7. Website Use

You may use our website for lawful purposes only. You must not use the site to transmit unsolicited communications, attempt to gain unauthorised access to our systems, or engage in any activity that disrupts or damages our website or services.

8. Governing Law

These Terms of Service are governed by the laws of England and Wales. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated to active clients. Continued use of our website after an update constitutes acceptance of the revised terms.
